1. Who we are

SUPGARDEN is a product of SUPCON BV, Kruisheide 1 D, 3140 Keerbergen, Belgium, company number 1014.093.032.

2. What the software is for

SUPGARDEN helps you draw a garden plan and derive quantities and a plant list from it. It is a tool, not a replacement for professional judgement. The dimensions, counts and volumes the software shows remain your responsibility to check before you use them in a quote or on site.

3. Land registry data

Plot and building outlines come from open data published by the Flemish government. We are not the source of that data and cannot guarantee it is complete or current. Where work has to be right to the centimetre, measuring on site remains necessary.

4. Trial, subscription and payment

The trial lasts seven days and requires no payment details; nothing is charged automatically. Subscriptions then run monthly and can be cancelled monthly, unless you explicitly choose an annual subscription. Prices are stated excluding VAT.

5. Cancellation

You can cancel at any time, effective at the end of the current payment period. Periods already paid are not refunded, except where the law requires it.

6. Your data and plans

Your plans remain yours. We acquire no rights to them and do not use them for other purposes.

7. Availability

We do our best to keep the software available, but we cannot guarantee uninterrupted availability. Maintenance, outages at our suppliers or at the public open data services can cause temporary interruptions.

8. Liability

Our liability is limited to the amount you paid for SUPGARDEN in the twelve months preceding the damage. We are not liable for indirect damage such as lost profit or lost contracts. Nothing in these terms limits liability that the law does not allow to be limited.

9. Governing law

Belgian law applies. Disputes belong before the competent courts of the district in which SUPCON BV is established.
